On May 27, 2009, John Yoo wrote a piece in The Daily Beast titled "Empathy Trumps Excellence," in which he criticized the nomination of Judge Sonia Sotomayor for the Supreme Court by saying, "liberals have missed their chance to put on the court an intellectual leader who will bring about progressive revolution in law." But six days earlier, Yoo complained that Obama wanted to appoint a judge who would favor exactly that kind of "progressive revolution." In less than a week, John Yoo moved from criticizing Obama for favoring activist judges to criticizing Obama for not appointing a revolutionary.
